Our commitment to your privacy

Brainium Studios, LLC, an Oregon corporation (“Brainium”, “we” or “our”), respects your individual privacy.

Scope of the Privacy Policy

This Privacy Policy covers our treatment of information that may be collected while you are on a Brainium website, when you order, download, and/or use Brainium products (i.e., mobile applications) or services, or information that is shared with Brainium by its business partners (collectively, “Services”). We do not intend to collect, nor do we sell to any third parties, information that personally identifies you; the information that we collect is typically anonymous and used only to provide and improve the Services.

  • What information is collected by Brainium or by any third parties through our Services
  • How Brainium uses this information
  • With whom Brainium may share this information
  • What choices are available to you as a user of the site and/or products and services with respect to collection, use and distribution of the information

Information Collection and Use

Brainium may collect information from you at the following three different stages.

First, we collect anonymous non-personal information from all users of our Services. For example, when using our mobile applications, our servers may automatically record certain information about your use of the application such as your Internet Protocol (IP) address, device type, operating system, the links and advertisements on our mobile applications that you clicked on, the amount of time you spent interacting with the Services and other statistics. We use this information to administer our Services and we analyze (and may engage third parties to analyze) this information to improve and enhance the Services by expanding their features and functionality and tailoring them to our users’ needs and preferences. We also use the IP Address to generate aggregate, non-identifying information about how our Services are used. In some cases we collect and store information about where you are located, such as by converting your IP address into a rough geolocation. We may use location information to improve and personalize our Services for you. When you access the Services via a mobile device, we will collect information related to the mobile device such as the serial number or MAC address and the open UDID of the device. We may use this information to improve and personalize our Services for you.

Second, in certain limited circumstances, Brainium may have access to personally identifiable information when you use the Services. Personally identifiable information is information that identifies you or that could be used to contact you off-line or on-line (such as your full name, email address, postal address, phone number, credit card information and in some cases user names, etc.). You may make personal information available to Brainium when you (i) access the Services using a third-party social network (such as Facebook or Game Center), or (ii) otherwise use the Services where personal information is required for use and/or participation. Note that by using a Brainium mobile application through a third party social network or other third party platform or service (a “Third Party Social Network”), or by connecting to a Third Party Social Network via a Brainium mobile application, you thereby authorize Brainium to collect, store and use any and all information in accordance with this Privacy Policy and that you agreed that such Third Party Social Network could provide Brainium information based on your settings on such Third Party Social Network.

Third, Brainium may also receive personally identifiable information from our business partners or other users.

Use of Your Personal Information

As stated above, we do not intend to collect, nor do we sell to any third parties, information that personally identifies you. The information that we collect is typically anonymous and used only to improve your experience with our Services. Our primary goal in collecting information from you is to provide you with a smooth and efficient experience while using the Services. However, in the event we obtain your personal information during your use of the Services, we will not give your personal information to, nor share your personal information with, any third party not affiliated with or owned by Brainium, except with your express permission, or when otherwise permitted by law. For example, Brainium may send personally identifiable information about you to other companies or people when:

  • We have your express consent to share the information (including consent in this Privacy Policy)
  • We need to share your information to provide the Services you have requested
  • We need to send the information to companies who work on behalf of Brainium to provide the Services to you
  • We respond to subpoenas, court orders, or legal process or find that your actions violate any Brainium agreement or any of our usage guidelines for specific Services

We store information that we collect through cookies and log files to create a profile of our customers. A profile is stored information detailing how individual customers use the Services. Collected information in a profile may be tied to the customer’s personally identifiable information. We use your profile to help us improve your experience.

Cookies and Other Tracking Technology

In connection with the collection of both personal information and anonymous non-personal information, we may also use cookies and other technologies to learn more about your use of our Services. A cookie is a small text file stored on the customer’s hard drive for an extended period of time. Cookies will allow us to learn what web pages you visit and which features of the Services are used. The cookies can be removed by following Internet browser help file directions. Brainium and its third party partners may also use pixels, Clear GIFs (aka web bugs, beacons or tags) to manage and measure the performance of advertising.

Log files

Log files record internet protocol (IP) addresses, browser types, internet service provider (ISP) referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track a customer’s movement in the aggregate and gather broad demographic information for aggregate use.

Analytic Metrics and Other Technologies

Our Services may contain third party tracking tools from our service providers, examples of which include Google Analytics and Flurry. Such third parties may use cookies, APIs, and/or SDKs in our Services to enable them to collect and analyze user information on our behalf. The third parties may have access to information such as your device identifier, MAC address, IMEI, locale (specific location where a given language is spoken), geo-location information, and IP address. We use analytics information for supporting business analysis and operations, business intelligence, product development, improving products and services, personalizing content, providing advertising, and making recommendations. These third party tracking tools may also use a technology called conversion tracking. We use conversion tracking to judge the quality of the campaigns we are running to promote Brainium products. For example, you may see our mobile applications advertised in other services. After clicking on one of these advertisements and installing a Brainium mobile application, conversion tracking allows us to verify the installation and a device identifier may be shared with the applicable third party advertiser. A non-exclusive list of analytics companies that operate their own technologies on or through our Services can be found below. By using the Services you agree that such analytics companies may collect and use data and information in accordance with applicable privacy policy for such company.

Ad Serving Technology

We may feature advertising within our Services. The advertisers may collect and use information about you, such as your session activity, device identifier, MAC address, IMEI, geo-location information and IP address. They may use this information to provide advertisements of interest to you. By using the Services you agree that such third party advertisers may collect and use data and information in accordance with privacy policy of the company providing the ad serving technology. Links of the relevant privacy policies from ad serving companies that operate their own networks on our Services are provided below. Brainium is not responsible for the information practices of advertisers and partners. The collection, use, and disclosure of information by advertisers and partners are subject to their respective privacy policies, which may differ from this Privacy Policy.

Children under 13

Our Services are not directed to children under 13 and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information of a child under 13 we will take steps to delete such information from our files as soon as possible.

Disclosure of Personal Information As Required By Law

We will disclose personal information when required by law, or if we have good-faith belief that such action is necessary to (a) comply with current judicial proceedings, a court order or legal process served on us, (b) protect and defend our rights, or (c) protect the rights, property, and other interests of our users or others.

Business Transitions

In the event that Brainium goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, our customers’ personal information may be part of the assets transferred. If, as a result of the business transaction, your personally identifiable information will be used in a manner materially different from that stated at the time of collection, you will be given a choice consistent with our Notification of Changes section.

The Services may contain links to and portions of other sites or services. Brainium is not responsible for the privacy practices or content of these other sites or services. When you leave our Services or view a portion of a third party’s site or services through our Services, we encourage you to read the privacy statements of each such site or third party service. This Privacy Policy applies solely to information collected by Brainium.
